Akta Notaris Berupa Pengakuan Hutang Dan Sekaligus Kuasa Jual Telah Melanggar Hukum

Akta Notaris Berupa Pengakuan Hutang Dan Sekaligus Kuasa Jual Telah Melanggar Hukum

Analisis Hukum Kenotariatan dan Yurisprudensi Mahkamah Agung
Language:

Pendahuluan

Introduction

A notarial deed is an authentic instrument drawn up by or before a notary in accordance with statutory formalities. In practice, however, deeds are often found to contain multiple legal acts, such as a debt acknowledgment combined with an absolute power of sale.

Legal Analysis

Combining more than one legal act in a single deed violates fundamental notarial principles and deprives the deed of its executorial force.

Conclusion

Such deeds undermine legal certainty and may be declared null and void under Indonesian law.
